Terms of Service

These Terms of Service govern your access to and use of the MyGenie platform. By using MyGenie, you agree to be bound by these terms.

Your Data
You retain ownership of all content you submit. We do not use your data to train public AI models.
Fair Use
Use MyGenie for lawful purposes. Do not attempt to extract, reverse-engineer, or abuse the platform.
Subscriptions
Paid plans renew monthly. Cancel anytime from your dashboard. See our Refund Policy for details.

1. Acceptance of Terms

By accessing or using MyGenie ("the Platform", "we", "us", "our"), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, you must not use the Platform. We may update these terms from time to time and will notify you of material changes via the email associated with your account.

2. Description of Service

MyGenie is an AI-powered professional advisory platform that provides structured guidance across business, legal, finance, tax, and technology domains. The Platform includes a web application, messaging channel integrations (WhatsApp, Telegram), email interaction, and various specialist AI modes. 3. Accounts and Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to use the Platform.
  • One account per person. Shared or automated account access is not permitted.
  • We reserve the right to suspend or terminate accounts that violate these terms.

4. Free Trial

New users receive a free 7-day trial with full access to the Platform. No payment information is required to start a trial. At the end of the trial period, access reverts to the free tier unless you subscribe to a paid plan. Trial access is limited to one per person.

5. Subscriptions and Payments

  • Paid subscriptions are billed monthly via PayFast, a South African payment processor.
  • Prices are shown in South African Rand (ZAR) for visitors in South Africa, and in the relevant local currency for visitors elsewhere (determined from your IP address). Prices in ZAR are inclusive of VAT where applicable; prices in other currencies are inclusive of local sales tax where applicable.
  • Subscriptions renew automatically at the end of each billing cycle unless cancelled.
  • You may cancel your subscription at any time from your settings/profile page. Access continues until the end of the current billing period.
  • Refunds are governed by our Refund & Cancellation Policy.

6. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose or to violate any applicable laws or regulations.
  • Attempt to gain unauthorised access to any part of the Platform, other accounts, or connected systems.
  • Reverse-engineer, decompile, or attempt to extract the source code or AI prompts of the Platform.
  • Use automated tools (bots, scrapers, crawlers) to access or interact with the Platform without prior written consent.
  • Transmit malware, viruses, or any code of a destructive nature.
  • Resell, redistribute, or sublicense access to the Platform or its outputs without written permission.
  • Use the Platform to generate content that is defamatory, harassing, or infringes the intellectual property of others.

7. Intellectual Property

  • Your Content: You retain ownership of all content you submit to the Platform (prompts, documents, data). By submitting content, you grant us a limited licence to process it solely for the purpose of providing the service.
  • AI Outputs: You may use AI-generated outputs for your personal or business purposes, subject to these terms. Outputs should not be represented as human-authored professional advice.
  • Platform IP: The Platform, including its design, branding, code, AI prompts, and specialist knowledge structures, is the intellectual property of MyGenie and is protected by South African and international copyright law.

8. Third-Party Integrations

The Platform integrates with Google (Gmail and Calendar, via the Secretary Genie feature), Microsoft (Outlook mail and calendar, Teams chats and meetings, and OneDrive / SharePoint files, also via Secretary Genie), and with other service providers for messaging, email delivery, payments, hosting and analytics. When you connect a third-party account:

  • We request only the minimum permissions required for the feature you are using.
  • For Google, we request only read-only scopes and cannot send mail, modify calendar events, or take any other action on your account.
  • For Microsoft, some features (sending Outlook mail, creating or sending Teams chats) do use write scopes, but Secretary Genie always confirms subject, body, and recipients with you in-chat before sending, and will never send, reply, or create a chat without your explicit go-ahead in that confirmation turn.
  • You may disconnect third-party accounts at any time from your Settings page.
  • Third-party services are governed by their own terms and privacy policies.

9. Data Protection and Privacy

We are committed to protecting your personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA) and all applicable South African data protection legislation. Full details of how we collect, store, and process your data are set out in our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by South African law, MyGenie shall not be liable for any damages of any kind - whether direct, indirect, incidental, special, consequential, or punitive - including but not limited to loss of profits, data, business opportunities, goodwill, or any other intangible losses, arising from or in connection with your use of the Platform. AI-generated content is provided "as is" without warranties of any kind, and you use the Platform at your sole risk. Nothing in this clause purports to limit any liability that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 or any other applicable law of the Republic of South Africa. 11. Termination

  • You may close your account at any time by contacting support via the Contact Us page.
  • We may suspend or terminate your account if you violate these terms, with or without notice.
  • Upon termination, your right to access the Platform ceases immediately. Data retention is governed by our Privacy Policy.

12. Governing Law and Jurisdiction

These terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
